IMPORTANT: Please read these Terms and Conditions carefully before accessing or using the TestCrate platform. By registering, accessing, or using this website, you signify your unconditional acceptance of these Terms. If you do not agree, please discontinue use immediately.
1. Introduction and Overview
Welcome to TestCrate (“we”, “us”, “our”, or “Platform”), an online examination and test-preparation platform accessible at www.testcrate.com. TestCrate is operated by [Company Legal Name], a company incorporated under the laws of India, with its registered office at [Registered Address], India.
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and TestCrate governing your access to and use of the Platform, including all content, features, examinations, test series, results, certificates, and services offered thereon.
These Terms are governed by and shall be construed in accordance with the laws of India, including but not limited to:
- The Information Technology Act, 2000, and the rules framed thereunder
- The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
- The Consumer Protection Act, 2019
- The Indian Contract Act, 1872
- The Copyright Act, 1957
2. Eligibility and User Registration
2.1 Age Requirement: You must be at least 13 years of age to use TestCrate. Users below 18 years of age (“Minors”) may only access the Platform with the prior express consent of a parent or legal guardian. By registering, you represent and warrant that you meet the eligibility requirements.
2.2 Account Registration: To access certain features of the Platform, you must create an account. You agree to:
- Provide accurate, complete, and current information during registration, including your full legal name, a valid email address, and a mobile number
- Maintain and promptly update your account information to keep it accurate and current
- Maintain the confidentiality of your login credentials and be solely responsible for all activity under your account
- Notify us immediately at support@testcrate.com upon becoming aware of any unauthorised access to or use of your account
2.3 One Account Per User: Each user is permitted to maintain only one account. Creating multiple accounts to gain unfair advantages in examinations, rankings, or leaderboards is strictly prohibited and may result in permanent suspension of all associated accounts.
2.4 Institutional Users: Educational institutions, coaching centres, or organisations registering on behalf of students must ensure they have obtained appropriate authorisation from the respective individuals and that use of the Platform complies with applicable data protection and privacy laws.
3. Permitted Use of the Platform
3.1 Licence: Subject to your compliance with these Terms, TestCrate grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial educational purposes.
3.2 Permitted Activities: You are permitted to:
- Enrol in and attempt examinations, quizzes, and test series made available on the Platform
- View your scores, performance analytics, and result history
- Download and share certificates issued by TestCrate in respect of your own results
- Access study material and resources provided on the Platform
3.3 Prohibited Conduct
You expressly agree NOT to:
- Cheat, engage in impersonation, or use any unfair means during an examination, including using unauthorised aids, software bots, or screen-sharing tools
- Share, reproduce, upload, publish, or distribute any examination question, answer, or content from the Platform without prior written consent from TestCrate
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Platform
- Use automated scripts, bots, scrapers, crawlers, or any non-human means to access, mine, or extract data from the Platform
- Upload or transmit viruses, malware, ransomware, or any other malicious code that could compromise the Platform’s security or integrity
- Attempt to gain unauthorised access to any portion of the Platform, other user accounts, or our servers and databases
- Use the Platform for any unlawful purpose or in violation of any applicable Indian or international law
- Harass, abuse, defame, or threaten other users, or post content that is obscene, pornographic, hateful, or discriminatory
- Misrepresent your identity or affiliation with any person or entity while using the Platform
- Commercially exploit, resell, or sublicence access to the Platform or its content without authorisation
4. Examinations, Results, and Certificates
4.1 Examination Conduct: TestCrate operates an automated examination system. Examinations are time-bound and subject to specific rules disclosed at the commencement of each exam. Once an examination is submitted—whether manually, upon timer expiry, or due to a detected integrity violation—the submission is final and cannot be reversed.
4.2 Accuracy of Results: While TestCrate endeavours to ensure the accuracy of all examination results, the Platform is provided on an “as is” basis. In the event of a technical error that demonstrably affects your result, please contact us within 7 (seven) calendar days of the result being published. We will investigate and, where appropriate, take corrective action.
4.3 Certificates: Digital certificates issued by TestCrate are intended solely as evidence of completion or performance on the Platform. They do not constitute qualifications recognised by any government body, university, or regulatory authority unless explicitly stated. TestCrate reserves the right to revoke a certificate if it is subsequently determined that the examination was attempted through fraudulent means.
4.4 Leaderboards: Leaderboard rankings reflect performance data as recorded by our system. TestCrate reserves the right to remove any user from a leaderboard if there is reasonable evidence of dishonest conduct.
5. Intellectual Property Rights
5.1 Ownership: All content on the Platform, including but not limited to examination questions, answer options, explanations, study materials, graphics, logos, software code, databases, and user interface design, is the exclusive intellectual property of TestCrate or its licensors and is protected under the Copyright Act, 1957 and other applicable Indian and international intellectual property laws.
5.2 Restrictions: You are strictly prohibited from:
- Copying, reproducing, distributing, or creating derivative works from any Platform content without prior written permission
- Republishing examination questions or answers in any format, including on social media, YouTube, Telegram, WhatsApp groups, or third-party websites
- Using TestCrate’s name, logo, or branding in any manner that implies endorsement without our consent
5.3 User-Generated Content: If you submit any feedback, suggestions, or other content to TestCrate, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide licence to use, reproduce, modify, and publish such content for any purpose, without any obligation of confidentiality or compensation to you.
6. Privacy and Data Protection
6.1 Collection and Use: TestCrate collects personal data including your name, email address, mobile number, performance data, and usage information in accordance with our Privacy Policy, which is incorporated into these Terms by reference and is available at www.testcrate.com/privacy-policy.
6.2 Compliance with Indian Law: TestCrate processes personal data in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and shall align its practices with the Digital Personal Data Protection Act, 2023 as and when applicable provisions come into force.
6.3 Data Retention: We retain your account and examination data for a period of 3 (three) years from your last active session, after which data may be anonymised or deleted, unless retention is required by law.
6.4 Consent for Communications: By registering on the Platform, you consent to receiving transactional messages, result notifications, and promotional communications from TestCrate via email, SMS, or WhatsApp. You may opt out of promotional communications at any time by clicking the unsubscribe link or contacting us directly.
7. Fees, Payments, and Refund Policy
7.1 Pricing: Certain features, test series, or content on TestCrate may be offered on a paid basis. All prices are displayed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless otherwise indicated.
7.2 Payment Security: Payments are processed through third-party payment gateways that comply with applicable Reserve Bank of India (RBI) regulations and PCI-DSS security standards. TestCrate does not store your full card details or UPI credentials.
7.3 Refund Policy:
- Refund requests must be submitted within 7 (seven) days of the date of purchase by writing to us
- Refunds will not be granted if you have accessed, attempted, or viewed the purchased examination or test series content
- Refunds for technical failures that prevent access will be considered on a case-by-case basis
- Approved refunds shall be credited to the original payment source within 7–10 business days
7.4 Disputes: In the event of a payment dispute, you agree to first contact TestCrate to seek an amicable resolution before initiating any chargeback or consumer complaint.
8. Disclaimers and Limitation of Liability
8.1 No Warranty: The Platform and all content thereon are provided on an “AS IS” and “AS AVAILABLE” basis without any representations or warranties, express or implied. TestCrate does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
8.2 Educational Purpose Only: TestCrate is a preparatory and self-assessment tool. Scores and rankings obtained on the Platform do not guarantee selection, admission, or success in any competitive examination conducted by the Government of India, state governments, universities, or any other authority.
8.3 Limitation of Liability: To the maximum extent permitted under applicable Indian law, TestCrate, its directors, employees, and affiliates shall not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform
- Loss of data, loss of opportunity, or any financial loss arising from reliance on the Platform’s content or results
- Any interruption, suspension, or termination of the Platform or any feature thereof
8.4 Indemnification: You agree to indemnify and hold harmless TestCrate, its officers, directors, employees, and agents against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your violation of any law or third-party rights, or (c) your use of the Platform.
9. Third-Party Links and Services
The Platform may contain links to third-party websites, applications, or services. These links are provided for convenience only. TestCrate does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.
10. Suspension and Termination of Account
10.1 By TestCrate: We reserve the right, in our sole discretion, to suspend, restrict, or permanently terminate your account and access to the Platform at any time, without prior notice, if we have reasonable grounds to believe that you have:
- Violated any provision of these Terms
- Engaged in dishonest, fraudulent, or unlawful conduct on the Platform
- Provided false or misleading information during registration
- Created multiple accounts to circumvent a ban or restriction
10.2 By the User: You may deactivate your account at any time by writing to support@testcrate.com. Upon deactivation, your access to paid content and examination history will cease. TestCrate may retain certain data as required by law or for legitimate business purposes.
10.3 Effect of Termination: Upon termination, all licences granted to you under these Terms shall immediately cease. Provisions that by their nature should survive termination (including intellectual property, indemnification, disclaimer, and dispute resolution clauses) shall continue to apply.
11. Governing Law and Dispute Resolution
11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
11.2 Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform that cannot be resolved amicably within 30 (thirty) days of written notice shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be [City, India]. The proceedings shall be conducted in English by a sole arbitrator mutually appointed by the parties.
11.3 Jurisdiction: Notwithstanding the above, either party may seek interim or injunctive relief from the courts of competent jurisdiction at [Dehradun, India], which shall have exclusive jurisdiction over all matters arising from these Terms that are not subject to arbitration.
11.4 Consumer Rights: Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act, 2019 or any other applicable consumer protection legislation in India.
12. Changes to These Terms
TestCrate reserves the right to modify, update, or replace these Terms at any time. We will notify registered users of material changes via email or a prominent notice on the Platform to the changes taking effect, except where changes are required immediately for legal or security reasons. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
13. Force Majeure
TestCrate shall not be held liable for any failure or delay in performance of its obligations under these Terms arising from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet outages, power failures, civil unrest, or cyberattacks.
14. Miscellaneous Provisions
14.1 Entire Agreement: These Terms, together with our Privacy Policy and any other guidelines published on the Platform, constitute the entire agreement between you and TestCrate with respect to the subject matter hereof and supersede all prior agreements, representations, and understandings.
14.2 Severability: If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
14.3 Waiver: Failure by TestCrate to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment: You may not assign or transfer your rights or obligations under these Terms without TestCrate’s prior written consent. TestCrate may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
14.5 Language: These Terms are drafted in the English language. In the event of any conflict between the English version and any translated version, the English version shall prevail.
